Withdrawal Policy

1. Your Right of Withdrawal

In accordance with Romanian Government Emergency Ordinance no. 34/2014 (OUG 34/2014) transposing EU Directive 2011/83/EU on consumer rights, you have the right to withdraw from a distance contract within 14 calendar days without giving any reason.

The withdrawal period expires 14 calendar days from the day on which the contract was concluded (i.e., the date of your purchase).

2. Exception for Digital Content

Per Article 16(m) of OUG 34/2014, the right of withdrawal does not apply to contracts for the supply of digital content which is not supplied on a tangible medium if the performance has begun with your prior express consent and your acknowledgement that you thereby lose your right of withdrawal.

When purchasing digital products on AOVANCY, you are asked to expressly consent to the immediate delivery of the digital content and to acknowledge that you waive your right of withdrawal. If you provided this consent at checkout, you cannot request a withdrawal after the content has been delivered.

If you did not provide this consent, your full 14-day withdrawal right applies.

3. How to Exercise Your Right

To exercise your right of withdrawal, you must inform AOVANCY of your decision to withdraw from the contract by an unequivocal statement. You can do this:

• Online: Visit your Purchases page and click "Request Withdrawal" on the relevant order
• By email: Send your withdrawal request to support@aovancy.com

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the 14-day period has expired.

5. Effects of Withdrawal

If you withdraw from the contract, AOVANCY shall reimburse all payments received from you for the product in question, without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw.

The reimbursement will be carried out using the same means of payment as you used for the initial transaction (via Stripe), unless you have expressly agreed otherwise.

Upon approval of your withdrawal, your access to the digital content will be revoked and the corresponding purchase will be deactivated.

6. Conformity Guarantee (OUG 141/2021)

In addition to the withdrawal right, Romanian Government Emergency Ordinance no. 141/2021 (transposing Directive (EU) 2019/770) provides you with a legal guarantee of conformity for digital content and services.

A digital product is considered conforming if it:

• Matches the description, type, and quality specified in the product listing
• Is fit for the purposes for which digital content of the same type would normally be used
• Is delivered with all accessories and instructions as described
• Is updated as specified in the contract or as reasonably expected

If a digital product does not conform to these requirements, you have the right to have it brought into conformity free of charge. If bringing it into conformity is impossible or disproportionate, you are entitled to a proportionate price reduction or termination of the contract and a full refund.

The conformity guarantee applies for 2 years from the date of delivery of the digital content. For the first year, the burden of proof lies with the trader (AOVANCY/the creator); after the first year, the burden shifts to the consumer.
